Looking Ahead In 1985, the Florida Clean Indoor Air Act was created to provide a healthy and clean environment for Floridians. Legislation in 2002 and again in 2018 further restricted indoor smoking and vaping while local regulations keeping cigarette “butts off the beaches” were preempted by the state and challenged in the courts. Now, effective July 1st, CS/HB 105 titled, “The Florida Clean Air Act,” authorizes municipal governments to further restrict smoking within their public parks and beaches. Although unfiltered cigars are exempt from the law “local voices making local choices” is a step towards the “Home Rule Authority” our residents deserve.
